Terms of Use
These Terms of Use ("Terms") are a binding agreement between you and Kervan LLC, a Wyoming limited liability company, 30 N Gould St Ste N, Sheridan, WY 82801, USA ("we", "us", "our"). Kervan LLC operates the Degenly website at degenly.app and its related pages and interfaces ("Degenly").
Please read these Terms together with the Risk Disclosure (/risk) and the Privacy Policy (/privacy). The Risk Disclosure is part of these Terms. If you join the Referral Program, the Referral Program Terms (/referral-terms) also apply to you. By connecting a wallet, signing in, or using Degenly in any other way, you accept these Terms. If you do not accept them, do not use Degenly.
1. What Degenly is, and what it is not
- Degenly is software. It is a web interface that shows market data for tokens on the networks shown in Degenly (Solana, Ethereum, Base and BNB Chain) and lets you prepare swap transactions that are signed and sent from your own wallet: either a wallet app you connect (an "External wallet") or a self-custody wallet you create in Degenly (a "Degenly wallet", see section 2A). On Solana, it also lets you place orders that run later, including DCA (section 6A).
- On Solana, swaps are routed and executed by Jupiter, a third-party protocol and API that we do not own or control, and orders are created, held and carried out by Jupiter's Trigger service. On Solana, Degenly is Powered by Jupiter. On Ethereum, Base and BNB Chain, swap routes come from the KyberSwap Aggregator API, a third-party service that we do not own or control.
- We are not a party to your trades. We are not an exchange, a broker, a dealer, a market maker, a custodian, a bank, a money transmitter or an investment adviser. We do not buy or sell tokens to you or for you, and we do not match orders.
- We are not registered or licensed with the U.S. Securities and Exchange Commission or with any other financial regulator, and Degenly is not supervised by one.
- We do not issue, list for payment, endorse or review tokens. Tokens shown in Degenly were created by third parties. We do not create tokens.
- No advice. See section 8.
2. Your wallet and your keys (non-custodial)
- Degenly is non-custodial. We never hold your funds, and we have no access to your private keys or recovery phrase. You never deposit funds with us: when you "deposit" or "withdraw" in Degenly, you move tokens into or out of your own wallet address, and we never receive them.
- Orders are the one exception to "your own wallet address". When you place an order (section 6A), your wallet moves the order amount into an order vault that Jupiter operates for your wallet, not into an account of ours. We never receive it, and we cannot move or withdraw it.
- Every swap is signed by your own wallet. With an External wallet, your wallet app asks you to approve each transaction. With a Degenly wallet, transactions are signed in your browser during a trading session you start (section 2A). Our servers hold no key and cannot sign for you or move your funds on their own.
- Transactions on a blockchain cannot be reversed. Once a transaction is confirmed, we cannot cancel, change or refund it.
- If you lose your keys or recovery phrase, we cannot recover them, and you may lose access to your assets permanently.
- Signing in to Degenly is a message signature. It is free and does not move funds.
- We will never ask for your recovery phrase or private key, and we never send the first direct message. Anyone who does is not us.
- You are responsible for your wallet software, your device, and keeping your keys private.
2A. The Degenly wallet
- What it is. The Degenly wallet is a self-custody wallet that you create in Degenly with your email, Google or Apple account, and optionally a passkey. Its keys are created and managed by our wallet technology provider, Para (Capsule Labs, Inc.), using a method in which the key is split between your device and Para, and the full key is never put together in one place. Kervan LLC holds no part of the key. Para is a third party; we do not own or control it.
- Your login methods are the keys. Anyone who gets into the email, Google or Apple account you used, or your device with an open session, may be able to use your Degenly wallet. Protect those accounts with a strong password and turn on two-factor sign-in for them. We cannot reverse a transaction made by someone who got into your accounts.
- Trading sessions. When you start a trading session, trades sign in your browser without a separate pop-up, for up to the session length shown, and only within the limits you set. While a session is open, anyone using your browser can trade from your Degenly wallet. End the session when you stop trading. Code served by Degenly runs in your browser and can request signatures only while a session is open; we limit what it may sign, but we do not promise that no fault or attack could ever cause an unwanted transaction.
- Withdrawals and export. You can withdraw to another address and export your private keys at any time from the wallet panel. Export opens in a Para window, not on our page. After export, anyone who has the key controls the wallet, and neither we nor Para can help. The Solana key of a Degenly wallet may not open the same address in other Solana wallet apps; to move funds there, withdraw them.
- Back up. We strongly recommend exporting and storing your keys offline before you fund your Degenly wallet. If you lose access to all your login methods and did not export your keys, you may lose access to the wallet permanently, and we cannot restore it.
- If Para stops. If Para's service is interrupted, ends, or stops working with Degenly, you may be unable to use your Degenly wallet in Degenly until it returns. If we decide to change wallet provider or stop offering the Degenly wallet, we will tell you in Degenly at least 30 days before, unless the law or an emergency requires a faster change, so that you can withdraw or export.
3. Who may use Degenly
- Age. You must be at least 18 years old, or the age of majority where you live, whichever is higher. If you are not, you may not use Degenly.
- Capacity. You must be able to enter into a binding contract under the law that applies to you.
- Business use. If you use Degenly for a company or other organisation, you confirm that you can bind it to these Terms, and "you" includes that organisation.
- If we learn that you do not meet these requirements, we may block your access.
4. Restricted regions and your local law
Degenly is not offered to persons who are resident in, located in, or organised or incorporated in any of the following countries and regions ("Restricted Regions"):
- Cuba, Iran, North Korea and Syria
- Russia and Belarus
- Myanmar, Côte d'Ivoire, the Democratic Republic of the Congo, Iraq, Libya, Mali, Nicaragua, Somalia, Sudan, Yemen, Zimbabwe, Singapore and the People's Republic of China
- Venezuela, Viet Nam and the British Virgin Islands
- The following regions of Ukraine: Crimea, Sevastopol, Donetsk, Luhansk, Kherson and Zaporizhzhia
- Any other country or region that is subject to comprehensive sanctions of the United States, the United Kingdom, the European Union or the United Nations
These regions are restricted because of sanctions laws or because the swap routing services that Degenly relies on (Jupiter on Solana; KyberSwap on Ethereum, Base and BNB Chain) do not serve them. We may add a country or region to this list at any time and without notice, for example when a law, a sanctions program or a provider's terms change. The current list is always on this page.
How this is enforced. For each request, we check the country (and, where available, the region) that our hosting provider reports from the visitor's network location. Visitors from a country or region named in the list above see a "not available in your region" page and cannot use Degenly; only the legal pages stay open to them. This check is limited: network location can be wrong, and visitors whose location cannot be determined, or who connect through Tor, a VPN or a proxy, are not blocked automatically. The check does not replace your promises below.
Your promise about restricted regions. You confirm that you are not resident in, located in, or organised or incorporated in a Restricted Region, and that you will not use Degenly on behalf of, or for the benefit of, anyone who is.
No getting around the restriction. You must not use a VPN, proxy, Tor or any other tool or technique to hide that you are in a Restricted Region, or to get around this section in any other way. If we have reason to believe that a wallet is used from a Restricted Region, or to get around this section, we may block that wallet and may refuse any further access.
Your promise about your local law. Degenly is offered in English only and is not tailored to any particular country. Laws on crypto-assets, memecoins and trading interfaces differ from country to country, and some countries restrict or prohibit them. A country not being on the list above does not mean that using Degenly is lawful there. Before you use Degenly, you must check that using it, and trading memecoins, is lawful where you live and where you are. You confirm that your use of Degenly is lawful under every law that applies to you, and you are solely responsible for complying with those laws, including any licensing, reporting and tax rules. If using Degenly is not lawful for you, you must not use it. We do not represent that Degenly is lawful, appropriate or available in any particular country.
5. Sanctions
- Your promise. You confirm that you are not, and are not owned or controlled by, or acting for, any person who is named on a sanctions list maintained by the United States (including the OFAC Specially Designated Nationals and Blocked Persons List), the United Nations, the European Union or the United Kingdom, and that the assets you trade through Degenly do not come from, and will not be used for, any activity that breaches those sanctions. This promise applies wherever you are, including in countries that are not Restricted Regions, and you must tell us at once if it stops being true.
- Sanctions law applies to us. Kervan LLC is a United States company and must comply with U.S. sanctions in every country where Degenly can be reached. Opening Degenly to a country does not mean that sanctions no longer apply to people or wallets there.
- Wallet screening. When trading is enabled in Degenly, every wallet connected for trading is screened before a swap, an order or a wallet transfer is prepared. We screen against the U.S. sanctions list (the OFAC Specially Designated Nationals and Blocked Persons List), which we download from the U.S. Treasury and refresh every day. If a wallet matches, we do not prepare any transaction for it, and the interface shows "This wallet can't trade on Degenly." If the check cannot be completed, or our copy of the sanctions list is more than 72 hours old, no transaction is prepared until it can be. This includes Degenly wallets. Screening a wallet does not give us any control over the assets in it.
- What screening can and cannot do. Our screening is a reasonable and documented check, not a promise about any wallet. Sanctions lists name only some wallets, and a wallet can belong to a sanctioned person without being named on a list. A wallet that passes the check is not cleared of sanctions or other legal risk, and passing it does not change your promise above.
- Records. For each check, we keep a record of the result, the time and the version of the sanctions list we used, as described in the Privacy Policy (section 2h).
- Blocking on request or on reasonable grounds. We may block a wallet from Degenly when a provider of our swap routing, such as Jupiter, asks us to in writing, when the law or a competent authority requires it, or when we have reasonable grounds to believe that it is linked to a breach of sanctions, fraud, theft, a hack or another crime.
- If you think a block is a mistake, contact support (section 17). We may not be able to explain the reason for a block. Where U.S. sanctions rules require it, we report a refused transaction to the U.S. Treasury's Office of Foreign Assets Control.
6. Fees
- Degenly fee. We charge a fee on each swap you make through Degenly:
- Standard: 1.00% of the swap amount.
- High-volume: 0.75% for a wallet that has made swaps of USD 50,000 or more on Degenly in the last 30 days. The 30-day volume is measured by us from the swaps recorded for that wallet, using the U.S. dollar value at the time of each quote.
- The 30-day volume counts the swaps of the same wallet address on every network Degenly supports. Swaps from different wallet addresses are not added together, even if they are yours; a Solana wallet and an Ethereum-compatible wallet always have different addresses.
- Same fee for every token and route. The fee does not depend on which token you trade, which route or pool is used, or who the counterparty is. No one pays us to show, rank or place a token, and we take no payment from token creators or from routing or liquidity providers for your trades.
- How it is charged. The fee is taken inside the same swap transaction. On Solana, it is taken in one of the tokens of that swap, through Jupiter's referral fee mechanism, and Jupiter may keep a share of that fee under its program. On Ethereum, Base and BNB Chain, it is taken through KyberSwap's integrator fee: when you buy, from the ETH or BNB you pay; when you sell, from the proceeds of the sale before they reach you. KyberSwap takes no share of our fee. This does not change the amount you pay. The fee is set on our server for your wallet; if a quote comes back with any other fee, we do not show it.
- KyberSwap and trades that beat the quote. KyberSwap charges no fee of its own. On Ethereum, Base and BNB Chain, if a trade executes better than the quoted output, the part above the quote may go to KyberSwap, not to you or to us, and small leftover amounts that the route does not use may also go to KyberSwap. If the swap goes through, the router checks that it delivers at least the minimum amount shown before you sign; a token that charges a tax on transfers can still leave you with less.
- Only when a swap succeeds. The Degenly fee on a swap is taken only when the swap succeeds. Orders and DCA follow different rules: their fee is paid when the order is placed and is not refunded (section 6A).
- Referral discount and rewards. If you were invited to Degenly with someone's referral link, and your wallet is linked to that code under the Referral Program Terms (/referral-terms), you pay a Degenly fee that is 10% lower: 0.90% instead of 1.00%, and 0.67% instead of 0.75% at the high-volume tier, for as long as your wallet stays linked. The person who invited you may receive part of the fee we collect on your swaps; we pay this from our own revenue, and it never increases your costs. The fee that applies to a swap is always shown before you sign. The discount applies only to swaps and orders on Solana at present; swaps on Ethereum, Base and BNB Chain pay the standard or high-volume Degenly fee.
- Other costs are not ours. Network fees, priority fees and any fee charged by a token, pool or protocol are separate. They are not paid to us. On Ethereum, Base and BNB Chain, selling a token can first need a separate approval transaction, which has its own network fee. A failed transaction can still cost you a network fee.
- Shown before you sign. Before you approve a swap, Degenly shows the Degenly fee, the network and priority fees you pay, the price impact, and a single Total cost line.
- We may change our fees for future swaps. The current fees are always shown in the interface and on the /trust page. A change never applies to a swap you have already signed.
- No gaming of the tier. Trades made only to reach the high-volume tier (for example, wash trading between your own wallets) are not allowed. If we find them, we may reset the wallet to the standard fee.
6A. Orders and DCA (Solana only)
What orders are
- Order types. On Solana, Degenly lets you place orders that run later instead of at once: buy dip (a buy when the price falls to your target), take profit, stop loss, take profit and stop loss together, trailing stop, and DCA (a total amount spent in equal buys at a fixed interval). DCA is for buying only. Orders are not offered on Ethereum, Base or BNB Chain.
- Jupiter runs your orders, not us. Orders are created, held and carried out by Jupiter's Trigger service, a third-party service that we do not own or control. Jupiter's systems decide when an order's condition is met and carry it out. We do not execute, route or match orders.
- Signing in to orders. To place or manage orders, you sign a message for Jupiter with your wallet. It is free and does not move funds.
- Your deposit. When you place an order, your wallet signs a transaction that moves the order amount from your wallet into an order vault that Jupiter operates for your wallet. The amount waits there until the order fills, is cancelled or expires. We never receive your deposit. Our servers hold no key and cannot sign for you, move your deposit or withdraw it.
- Minimum amounts and limits. An order must be worth at least USD 10, measured by our server at the price it reads when you place the order. A DCA needs at least 2 buys, each worth at least USD 10, and an interval between 1 minute and 365 days. Jupiter may set further limits, such as how many DCA orders one wallet can run at the same time, and may refuse an order.
- Expiry. An order other than DCA expires at the end of the period you choose: 1, 7 or 30 days. A DCA runs until all its buys are done or you stop it.
- Always reviewed. Fast mode never applies to orders. Every order goes through a review screen before you sign.
The order fee
- Rate. We charge a Degenly fee on each order, at the rate that would apply to a swap by your wallet under section 6: 1.00% standard, 0.75% at the high-volume tier, or 0.90% or 0.67% if your wallet is linked to a referral code. Our server decides the rate for your wallet. Anything your browser sends cannot change it.
- What the fee is charged on. The fee is a percentage of the U.S. dollar value of the amount you deposit for the order. We use the token price and the SOL price our server reads when you place the order. For a DCA, the fee is charged on the whole DCA amount, for all its buys together. For take profit and stop loss placed together, there is one fee for both.
- Paid in SOL, when the order is placed. The fee is always paid in SOL, by a separate transfer from your wallet to Degenly that you sign at the same time as the deposit. The fee is rounded up to the smallest unit of SOL. We send the fee transfer to the network only after Jupiter confirms that your order exists and your deposit has landed. If Jupiter does not create the order, we do not send it. You need enough SOL in your wallet for the fee and the network costs, even when the order is in another token.
- Not refunded. The Degenly fee for an order is not refunded if the order is cancelled, expires, fills only in part or never fills, or if you stop a DCA before all its buys are done. The fee pays for setting up the order with Jupiter, not for the order filling.
- Shown before you sign. The review screen shows the order fee in SOL and as a percentage, and states that it is not refunded. Our server sets the final fee when you confirm. If that fee is more than 1% higher than the fee on the review screen, nothing is signed. Degenly then shows the new fee and asks you to confirm again.
- Unpaid order fees. Sometimes your order is created but your fee transfer does not reach the network. The fee then stays owed. It is added to the fee of your next order, and the review screen shows the added amount before you sign. Before we charge an owed fee again, we check on the network whether the earlier transfer landed, so the same fee is never charged twice.
- Exit strategy. If you add an exit strategy (take profit and stop loss) to a market buy, the exit order is charged after your buy fills. Its fee is at most the order fee rate applied to the U.S. dollar value of that buy. No unpaid fee from earlier orders is added to it.
- Orders and the fee tier. Orders and their deposits do not count toward the 30-day volume for the high-volume tier in section 6.
- Editing is free. Changing the target, trailing distance or slippage of an open order has no Degenly fee and needs no transaction.
- Other costs. The fee transfer is the only payment we receive for an order. Network fees for the deposit, the fee transfer, a cancellation or a withdrawal, and any fee that Jupiter, a pool or a token charges when an order fills, are separate. They are not paid to us.
- Fee changes. We may change order fees for future orders. A change never applies to an order you have already placed.
Cancelling, expiry and getting your funds back
- Cancelling. You can cancel an open order, or stop a DCA, at any time from the Orders tab. Cancelling has two steps. First, Jupiter prepares a withdrawal transaction. Degenly checks that the transaction sends funds only to your wallet before your wallet is asked to sign it. Second, you sign it. What is left of your deposit then goes back from the Jupiter order vault to your wallet, together with anything an order filled in part has bought. You pay the network fee for the withdrawal. If the second step does not go through, the order shows "Waiting for withdrawal" and you can use Withdraw to try again.
- Expired orders. When an order expires, its funds are not sent back to your wallet on their own. They stay in the Jupiter order vault until you withdraw them with Withdraw in the Orders tab.
- DCA. Each DCA buy is sent to your wallet when it runs. When you stop a DCA, the amount not yet spent goes back to your wallet after you sign the withdrawal.
- When trading is paused. If we pause trading, you can still see, cancel and withdraw your orders in Degenly. If we turn orders off in Degenly, or Jupiter's service is unavailable, you may be unable to cancel or withdraw through Degenly until it returns. Your funds stay in the Jupiter order vault during that time.
No promise that an order fills
- An order can fail to fill, fill late or fill at a worse price. An order can fill late or only in part. It can fill at a price worse than your target, within the slippage you set; for a stop loss, that slippage is 20% by default. It can also not fill at all. This can happen, for example, because the price moves fast or jumps past your target, there is not enough liquidity, a token cannot be traded or sold, or Jupiter, the network or a pool is slow, congested or down. A DCA buy can fail or be delayed for the same reasons.
- Targets set as market cap. If you enter a target as a market cap, Degenly turns it into a token price using the token supply shown at that time. The order then follows the price, not the market cap.
- No promise from us. We do not promise that any order fills, fills on time or fills at any price. Except as section 14 allows, we are not responsible for any loss from an order filling, filling in part or not filling.
- Orders run while you are away. An order keeps running until it fills, expires or you cancel it, even if the market or your plans change. Check your open orders and cancel the ones you no longer want.
- Jupiter's service. Jupiter may change, limit or stop its Trigger service at any time. Orders in Degenly may then stop working, and section 9 applies.
7. Using Degenly
- Quotes. Quotes come from the routing provider for that network (Jupiter on Solana; KyberSwap on Ethereum, Base and BNB Chain), change constantly and expire. A quote is an estimate, not an offer by us. What you receive is decided on-chain when your transaction runs and may differ from the quote within the slippage limit you set.
- Checks before you sign. Degenly simulates a transaction before you sign and allows only a fixed list of programs on Solana and of router contracts on Ethereum, Base and BNB Chain. These checks reduce some risks; they cannot remove them, and they can fail.
- Fast mode is available only on Solana and is off by default. If you turn it on, a preset tap skips the in-app review step whenever the quote is inside the limits you set. You are responsible for the limits you choose. With an External wallet, your wallet app still asks you to approve. With a Degenly wallet during a trading session, a tap signs and sends the swap at once, inside your limits, with no further approval.
- Degenly wallet trades. With a Degenly wallet, Buy and Sell may send a swap with one tap, without a separate review screen. Degenly shows the Degenly fee and the Total cost line before the tap, and asks you to confirm when price impact or slippage is high.
- Alerts only work while Degenly is open in a browser tab and may be late or not fire at all. Do not rely on them.
- Portfolio, PnL and share cards are estimates built from on-chain data and market data. They can be incomplete or wrong, especially for trades made in other apps.
- Wallet Tracker shows public on-chain activity of addresses you choose to follow. The names you give those addresses are yours; do not use names that identify a private person without a lawful reason. Tracked activity is information only, not a suggestion to copy any trade, and may be late or incomplete.
- Trading may be paused. We may pause trading, or turn off any feature, at any time and without notice, for example during a data outage, a security event or a legal requirement.
8. No investment advice
- Nothing in Degenly is investment, financial, trading, legal or tax advice, and nothing is an offer or a solicitation to buy or sell any token. Degenly is not directed at any person in any country where offering it, or using it, would be unlawful.
- Token lists, columns, filters, charts, token checks and flags are information only. Lists are ordered only by the objective measure shown on screen (for example newest, curve progress, market cap, volume, holders or liquidity). We do not give personal suggestions about which token to buy or sell.
- Token checks are data, not a verdict. A token can pass every check and still go to zero.
- You make your own decisions and are responsible for them.
9. Third-party services and data
- Jupiter. On Solana, swaps are routed and executed by Jupiter, and orders and DCA are created, held and carried out by Jupiter's Trigger service, including the order vault that holds your deposit. Jupiter, the pools it routes through, and the programs on the Solana network are not under our control. We are not responsible for their availability, performance, errors or losses they cause.
- KyberSwap. On Ethereum, Base and BNB Chain, swap routes come from the KyberSwap Aggregator API and run through KyberSwap's router contract. KyberSwap, the pools it routes through, and the contracts on these networks are not under our control. We are not responsible for their availability, performance, errors or losses they cause. KyberSwap may stop or limit access to its API at any time and without notice; swaps on these networks then stop until access returns or we use another provider.
- Para. The Degenly wallet uses technology from Para (Capsule Labs, Inc.). Para's service is not under our control. We are not responsible for its availability, performance, errors or losses it causes, except as set out in section 2A and section 14.
- Third-Party Data. Market data shown in Degenly, including prices, charts and token checks, is supplied by third-party providers, including CoinGecko, Jupiter and honeypot.is, and by the supported networks through our RPC providers. The CoinGecko API and its data are the property of Gecko Labs Pte. Ltd. ("CoinGecko"). You may view this data only within Degenly for your own use. You may not scrape, bulk-download, copy, store, resell, redistribute or make it available to anyone else, or use it to build a competing data product. CoinGecko and our other data providers have no liability to you for any use of their data or APIs through Degenly, and you agree not to bring any claim against them in connection with Degenly. Kervan LLC alone is responsible for offering this data to you as part of Degenly.
- Data accuracy and market risk. Kervan LLC is solely responsible for all disclosures, disclaimers and warnings about the nature, accuracy and limitations of the data shown in Degenly. Data may be delayed, incomplete or wrong. Crypto-asset markets, especially newly launched tokens, are extremely volatile and you can lose all of the money you swap. Nothing in Degenly is investment, financial or trading advice. Neither CoinGecko nor any other data provider is responsible for any financial decision you make or any result of such decision.
- Wallets and links. Your wallet software, and sites we link to (such as Solscan or DexScreener), are run by third parties under their own terms.
- Names of networks and providers. Degenly uses the names Solana, Ethereum, Base, BNB Chain, Jupiter, KyberSwap, honeypot.is and Para only to tell you which network or service is involved. Their owners do not endorse or sponsor Degenly, and Degenly is not affiliated with them.
- Licences and attributions are listed on the Third-party notices page (/third-party-notices).
10. What you must not do
You must not:
- use Degenly in or from a Restricted Region, or hide your location to get around section 4;
- use Degenly where doing so is unlawful for you;
- use Degenly in breach of sanctions or of any law that applies to you, including anti-money-laundering and market-abuse laws;
- manipulate markets, including wash trading, spoofing, coordinated buying or selling to move a price, or trading to deceive other users;
- use Degenly to launder money, finance terrorism or handle proceeds of crime;
- scrape Degenly, call our servers from outside the Degenly website, overload them, or use bots or automated tools against Degenly's interface or APIs, except through an official Degenly API under its own terms, if we offer one;
- copy, resell or redistribute Degenly's data or interface;
- attack, probe or reverse-engineer Degenly, or try to get around any limit or check in it;
- pretend to be Degenly or Kervan LLC, or use our name to mislead anyone;
- refer yourself, create or use wallets only to collect referral rewards, or otherwise abuse the Referral Program;
- promote Degenly with a referral link without clearly saying that you earn from it, or with promises of profit;
- help anyone else do any of the above.
11. Our rights in Degenly
Degenly, its design, software and content (other than third-party data and open-source components) belong to Kervan LLC or its licensors. We give you a limited, personal, non-exclusive, non-transferable and revocable right to use Degenly in line with these Terms. You get no other right. Open-source components are licensed under their own licences, listed on the Third-party notices page.
12. Suspending or ending access
- We may limit, suspend or end your access to Degenly, or block a wallet, at any time, with or without notice, if we believe you have broken these Terms, if the law or a sanctions program requires it, if a provider we rely on requires it, or to protect Degenly or its users.
- We may change, pause or stop Degenly, in whole or in part, at any time, including for a particular country or region.
- Because Degenly never holds your assets, ending your access does not take the assets in your wallet. If you use a Degenly wallet, we will keep withdrawal and key export available to you for at least 30 days after we end your access, unless the law, a sanctions program or Para's service prevents it. Funds in a Jupiter order vault stay there until the order fills or they are withdrawn (section 6A).
- You may stop using Degenly at any time.
13. Disclaimers
- Degenly is provided "as is" and "as available". To the fullest extent the law allows, we make no promise of any kind, express or implied, including about merchantability, fitness for a particular purpose, title, non-infringement, accuracy of data, uninterrupted or error-free operation, or the outcome of any transaction.
- We do not promise that Degenly, any token, any data or any transaction will be free of errors, attacks or losses.
14. Limitation of liability
- To the fullest extent the law allows, Kervan LLC and its members, managers, employees and contractors are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, tokens, data, goodwill or opportunity, arising from or related to Degenly, these Terms, any token, any third-party service, or any transaction, even if we were told such loss was possible.
- To the fullest extent the law allows, our total liability for all claims arising from or related to Degenly or these Terms is limited to the greater of (a) the Degenly fees you paid us in the 12 months before the event giving rise to the claim, or (b) USD 100.
- Indemnity. You agree to indemnify and hold Kervan LLC harmless from any claim, loss, fine or cost (including reasonable legal fees) that results from your breach of these Terms or your breach of any law or third-party right.
- Mandatory law. Nothing in these Terms excludes or limits any right or liability that cannot be excluded or limited under the mandatory consumer protection law that applies to you, or our liability for fraud or wilful misconduct.
15. Disputes
- Governing law. These Terms, and any dispute arising from or related to them or to Degenly, are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules.
- Talk to us first. Before starting any claim, send a written notice describing the dispute to the legal notices address in section 17. Both sides will try in good faith to resolve it within 30 days.
- Binding arbitration. If the dispute is not resolved within 30 days, it will be finally resolved by binding arbitration administered by the International Centre for Dispute Resolution (ICDR) under its International Arbitration Rules in effect when the arbitration begins. There will be one arbitrator. The place of arbitration is Wyoming, USA. The language is English. Hearings, if any, may be held by video. Judgment on the award may be entered in any court that has jurisdiction.
- Exceptions. Either side may bring an individual claim in a small-claims court that has jurisdiction, and either side may ask a court for urgent relief to protect intellectual property or to stop misuse of Degenly.
- Class action waiver. You and we may bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective or representative action or arbitration. The arbitrator may not combine claims of more than one person.
- Opting out. You may opt out of this arbitration agreement by email to the legal notices address within 30 days after you first accept these Terms. Your email must include your wallet address and a clear statement that you opt out. If you opt out, the courts of Wyoming, USA have exclusive jurisdiction.
- Time limit. To the extent the law allows, any claim must be started within one year after it arose.
- Mandatory law. These dispute terms do not take away any right that the mandatory consumer protection law of your place of residence gives you and that cannot be waived by agreement.
16. Changes to these Terms
We may change these Terms. When we do, we update the "Last updated" date and the version at the top of this page. A new version applies to your use of Degenly after you accept it; Degenly will ask you to accept the updated Terms before your next trade. If you do not accept them, you may not continue to trade, but you can still withdraw from or export a Degenly wallet. Version 2026-10-5 adds the Degenly wallet (section 2A) and the Wallet Tracker; each wallet accepts it before its next trade. Version 2026-10-7 describes wallet screening, blocking and screening records in more detail (section 5). Version 2026-10-8 adds orders and DCA on Solana, their fee and the rule that it is not refunded (section 6A).
